Rejection of Marriage Dispensation cases is a legal phenomenon that can arise in the context of marriage in Indonesia, especially involving couples who have not reached the minimum age permitted to marry, as regulated in Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. Marriage Dispensation case are submitted by parties who wish to marry even though their age does not meet the applicable provisions, for certain reasons such as emergency factors or religious reasons. However, marriage dispensation are often rejected by religious courts or district courts, depending on the applicable legal considerations. Rejection of Marriage Dispensation is generally based on considerations of child protection, reproductive health, and social and psychological risks that can arise from early marriage.
